A high-profile, former Boston prosecutor, who was charged with the rape and sexual abuse of a 25-year-old woman while she slept in a midtown Manhattan hotel in 2017 has been acquitted by a jury on all charges.
Adam Foss, 43, who gained national attention with a 2016 TED Talk about criminal justice reform, exchanged texts and calls for about a month with the woman he met at a conference, before the two spent the night together at a Midtown Manhattan hotel.
The woman repeatedly declined Foss’ advances but then claimed he raped her after she fell asleep, later coming forward with the allegations that prompted an investigation last year and subsequent trial that concluded on Friday.
Foss had always maintained their encounter was consensual.
In closing arguments at the trial last week, his lawyer Priya Chaudhry suggested to the jury the accuser’s account was not credible as she described Foss’ version of the night in question.

The lawyer then followed up with a discussion on text exchanges between the supposed victim and a friend where the accuser described Foss as ‘cute’ and ‘beautiful.’
Chaudhry claimed the woman’s account of what happened then changed after Foss ‘ghosted her.’
‘You may think that Mr. Foss should have been more considerate, but that is far different than deciding beyond a reasonable doubt that he committed a rape,’ Chaudhry said.
Allegations of misconduct against Foss surfaced in 2020, when a writer and singer published a blog post that accused Foss of raping her after the two met at a conference.
In the posting, the author detailed meeting Foss, their exchange of texts and calls and multiple meet-ups, including a night she woke up to Foss having sex with her in a Midtown Manhattan hotel room.

Foss, a former Massachusetts prosecutor, is now a Los Angeles resident. He has now been cleared of charges of first-degree rape and sexual abuse
Her post prompted Suffolk County District Attorney Rachael Rollins to launch an independent investigation into Foss’ behavior during his time as a prosecutor.
The report concluded that while Foss had shown ‘troubling’ behavior with young interns, but it did not rise to a criminal level.
Singer Raegan Sealy publicly accused Foss of raping her in a blog post after meeting him at a venue where he had been speaking and she had been performing.
The DA’s office has not confirmed if the accuser in the case was Sealy.
‘As Mr. Foss turns the page on this chapter, he looks forward to time with his wife and young son,’ Foss’ lawyer, Priya Chaudhry, said following his acquittal on Friday.
She added that he was ‘carefully evaluating his legal options to address the grave impact these false accusations have had on his life.’
Chaudhry said Foss wanted to express his ‘sincere appreciation to the jury and judge for their diligent discernment of the truth in a complex case.’

Foss, who is now a Los Angeles resident, was a prosecutor in the Suffolk County, Massachusetts.
He became known nationally known after he left office in 2016 and founded the nonprofit Prosecutor Impact.
The organization trained prosecutors in practices he believed might lower incarceration rates.
The trial loss is significant for Manhattan district attorney, Alvin Bragg, who has made the prosecution of sex crimes a priority.
A spokesperson for Bragg said prosecutors were disappointed by the verdict but respected the jury’s decision.
